Changing the Flag of a Ship

Charter of a ship registered at the Register of Seagoing Ships of the Republic of Lithuania changing the flag of the Republic of Lithuania to the flag of a foreign country

 

The owner of a ship applying for charter of a ship registered at the Register of Seagoing Ships of the Republic of Lithuania when changing the flag of the Republic of Lithuania to the flag of a foreign country shall submit an application specifying what country flag the ship will fly during the period of a bareboat charter to the Lithuanian Maritime Safety Administration. The documents apendant to the application shall be the following:


1. The original or a notarized copy of a bareboat charter specifying the name of a ship, the data on ship’s owner and charterer, the date of concluded bareboat charter and the term of its expiry;
2.  A certificate issued by the manager of a foreign country ship register confirming that the ship shall be registered in that State and be permitted to fly the flag of that State during the period of ship’s bareboat charter;
3.  If a ship is mortgaged – the documents specified in 1 part of article 81 of the Merchant Shipping Law of the Republic of Lithuania.

During the period of ship’s bareboat charter the validity of Permit to Fly Lithuania’s State Flag shall be suspended and the ship shall be registered at the register of a foreign country for that period. The owner of a ship shall return a Permit to Fly Lithuania’s State Flag to the Lithuanian Maritime Safety Administration and he / she shall be issued a Certificate of Suspension of Permit to Fly Lithuania’s State Flag instead.

A chartered ship has the right to fly the flag of the Republic of Lithuania before being registered at the ships register of a foreign state but no longer than indicated in Certificate of Suspension of Permit to Fly Lithuania’s State Flag. The above certificate indicates the period, during which a ship can fly the flag of the Republic of Lithuania, it equals to the period necessary for a ship to go to the registration port of a foreign state plus 15 calendar daysHaving temporarily changed the flag of the Republic of Lithuania to the flag of a foreign country, the registration port of a foreign country shall be indicated on the board side of a chartered ship. The owner of a ship shall provide a copy of a document proving the registration of the ship at a foreign state ships register to the Administration within 30 calendar days as of the ship’s registration in a foreign state ships register.

Upon expiry of bareboat charter or its termination prior to the expiry date the owner of a ship shall inform in writing thereof to the Lithuanian Maritime Safety Administration and delete the ship from the foreign state ship register.

Upon ship deletion from the ships register of a foreign country the Permit to Fly Lithuania’s State Flag shall be renewed. The owner of a ship together with an application to renew such a permit has to provide a copy of a document proving the ship’s deletion from a foreign state ships register and no later than within 14 calendar days – its original and the copies of a Ship Station License and ship’s class certificate to the Lithuanian Maritime Safety Administration.

 

Temporary registration of a ship at the Register of Seagoing Ships of the Republic of Lithuania changing the flag of a chartered ship to the flag of the Republic of Lithuania


A ship’s charterer applying for temporary registration of a chartered ship at the Register shall provide the following:
1.   The documents specified in paragraphs 8.1, 8.5 – 8.11 of the Regulations on Registration of Seagoing Ships of the Republic of Lithuania;
2.    A document in evidence of personal identity if a charterer is a citizen of the Republic of Lithuania;
3.   The original or a notarized copy of a bareboat charter, specifying the name of a ship, the data on ship’s owner and charterer, the date of concluded bareboat charter and its expiry date;
4.   The original certificate issued by a manager of ships register of a foreign state specifying the owner of a ship and the holder (or holders if any) of its collateral, security, mortgage or liens to the rights to the ship;
5.   The original document issued by a manager of ships register of a foreign state confirming the suspension of the right to fly the flag of the state where the ship is registered during the period of bareboat charter;
6. The original of consent of a chartered ship owner confirming that the ship can be temporarily registered at the Register of Seagoing Ships of the Republic of Lithuania during the period of bareboat charter.

 

Upon registration of a chartered ship at the Register of Seagoing Ships of the Republic of Lithuania, the following documents are issued for the period of bareboat charter:


1.   Certificate of Ship’s Temporary Registration at the Register of Seagoing Ships of the Republic of Lithuania (bareboat charter);
2.   Temporary Permit to Fly Lithuania’s State Flag;
3.   Minimum Safe Manning Document.

 

 

A chartered ship during the entire period of its registration at the Register of Seagoing Ships of the Republic of Lithuania can fly only the Lithuania’s State Flag.The name of a ship registered at the ships register of a foreign state is recognized.

A chartered ship shall be deleted from the Register when: 


1.   A charterer (or his / her authorized person) applies to delete a ship specifying the reason; 
2.   The Lithuanian Maritime Safety Administration receives the request of the ships register of a foreign state where the ship is registered to delete a ship from the Register of Seagoing Ships of the Republic of Lithuania or receives a document issued by the manager of ships register of a foreign state confirming the ship’s deletion from the foreign state ships register.

 

Upon the deletion of a chartered ship from the Register of Seagoing Ships of the Republic of Lithuania, it is not entitled to fly the flag of the Republic of Lithuania and the charterer of a ship shall return the documents specified in paragraph 45 of the Regulations on Registration of Seagoing Ships of the Republic of Lithuania to the Lithuanian Maritime Safety Administration.


Upon deletion of a chartered ship from the Register of Seagoing Ships of the Republic of Lithuania, the Lithuanian Maritime Safety Administration shall issue a Certificate of Deletion from the Register of Seagoing Ships of the Republic of Lithuania.
